LTD Tictic.me provides an online platform (hereinafter the “Platform”) that connects sellers and buyers seeking to respectively sell and buy tickets at the Internet address www.tictic.me. In particular, the Platform allows users to offer for sale and to purchase tickets for events in the areas of sports, concerts, entertainment, theater, musicals, etc. (hereinafter “Events”).
Tictic.me is a ticket marketplace that allows registered users to buy (in this capacity, “Buyer”) and sell (in this capacity, “Seller”) Tickets. The Seller (and not Tictic.me) sets the prices for the Tickets. As a marketplace, Tictic.me does not own the Tickets sold on the Platform. Ticket prices may be different from the face value of the Ticket.
While Tictic.me may provide pricing, listing and other guidance on the Platform, such guidance is solely informational and does not constitute a warranty as to accuracy. While Tictic.me may help facilitate the resolution of disputes between Buyer and Seller, it has no control over and does not guarantee the existence, quality, safety or legality of the Tickets; the truth or accuracy of Users’ content or listings; the ability of Sellers to sell Tickets; or Buyers to pay for them.
Your use of the Platform, including applications and access via smartphones and mobile devices, shall be governed exclusively by these General Terms and Conditions of Use (hereinafter collectively referred to as the “Terms and Conditions”).
The Terms and Conditions shall apply equally between Seller and Buyer and between Users (Sellers and/or Buyers) and Tictic.me. These Terms apply in addition to any Seller-specific terms provided by the Seller for each listing. If such specific terms are added by the Seller, they will be displayed in the listing and/or on the checkout page. The Seller cannot specify terms that conflict with these Terms and Conditions.
By clicking the respective button during registration, creation of an account, listing of a Ticket or completion of a transaction, the User consents to the applicability of these Terms and Conditions.
Tictic.me offers a marketplace featuring a wide variety of Event Tickets, with Sellers subject to the Platform’s applicable verification procedures. Personal information is stored and processed by Tictic.me in accordance with applicable law.
Tictic.me charges service and/or commission fees in connection with transactions conducted through the Platform. The applicable fees are displayed to Users during the relevant transaction process.
All sales completed through the Platform are final.
Tictic.me’s role is to facilitate a secure and convenient marketplace, assist Buyers in accessing available Tickets, assist Sellers in reaching potential Buyers, and provide procedures intended to reduce the risk of improper conduct by either party.
Users are strongly encouraged to use the Platform’s internal chat feature for communication. Any exchange of personal information between the Buyer and Seller through the internal chat is strictly prohibited, including names, surnames, personal photographs, telephone numbers, email addresses, social-media links or other direct contact information.
In order to be eligible for participation in the Platform, it is necessary to complete the prescribed registration process, including the correct provision of all requested information on the respective registration form.
Registration is free of charge except for any telecommunication costs which may occur. Only persons aged 18 and over with unlimited legal capacity, as well as legal entities, are entitled to register.
There is no right to be granted access to the Platform, and Tictic.me reserves the right to block specific Users from accessing and utilizing the Platform if it has grounds to believe that the User has infringed these Terms and Conditions or any applicable regulations or legislation.
Users are obliged to provide correct and complete information during the registration process. Users shall not pretend to be another person, use a name which they are not entitled to use, or otherwise infringe third-party rights.
If incorrect information is provided during registration, Users may be permanently or temporarily excluded from using the Platform.
Access to the Platform is protected by an individual password. Maintaining the security of the password is the sole responsibility of the User. Passwords must not be passed to third parties. Users are responsible for actions carried out using their account credentials and should immediately change their password if it becomes known to unauthorized parties.
Tictic.me provides a technology Platform that brings together Sellers and Buyers of Tickets for Events. Tictic.me neither hosts Events nor, unless expressly stated otherwise, sells the underlying Tickets.
Tictic.me does not take title to the underlying Ticket, and transactions for Tickets are concluded between Buyers and Sellers.
Tictic.me is independent from Event organizers unless the existence of a partnership and/or agreement with an organizer is expressly stated on the Platform.
There is no charge for User registration on the Platform.
Tictic.me may charge the Seller and/or Buyer a service or commission fee in connection with transactions conducted through the Platform. The applicable fee may be a fixed amount, a percentage of the transaction value, or otherwise calculated as indicated during the relevant transaction process. The applicable fee will be displayed to the User before completion of the transaction.
Tictic.me holds the Seller’s funds until the applicable payout conditions have been satisfied and processes Seller payouts within 5 working days after the Event, subject to these Terms and Conditions and the applicable payout procedures.
Tictic.me may technically edit offers posted by Users so that they can be appropriately displayed on mobile devices, applications or other supported interfaces.
Tictic.me shall be entitled to enforce price caps on specific Events or jurisdictions where appropriate or legally required.
Minors under the age of 18 are not eligible to use the Platform unsupervised, and Tictic.me requests that minors do not submit personal information to the Platform.
Users are not permitted to carry out unauthorized advertising, including self-advertising or external links, on or through the Platform.
Unless Tictic.me has granted express consent, Users undertake not to use data of other Users accessible through the Platform for advertising, unsolicited emails, unwanted communications, or purposes unrelated to use of the Platform.
Users shall not use information obtained through the Platform to contact Sellers or Buyers directly by email, telephone, social media or other channels for the purpose of conducting transactions outside the Platform or avoiding applicable Platform fees.
Users are encouraged to use the Platform’s internal chat feature. It is prohibited to share personal data, direct contact information, telephone numbers, email addresses or social-media links through the internal chat.
Users agree to utilize the Platform in accordance with applicable legislation and regulations.
Tictic.me reserves the right to take appropriate action against Users who breach these Terms and Conditions or applicable law, including restricting or terminating access to the Platform and, where permitted by applicable law, claiming damages incurred by Tictic.me.
Tictic.me takes the quality of content on its Platform seriously in order to support a safe and fair experience for Users.
As Users are able to create Events and Listings, Tictic.me provides mechanisms allowing Users to report content they believe may violate Platform rules or applicable legal requirements.
Users may report listings or Events through Tictic.me’s official support channel.
Personal information processed through Tictic.me’s Platform is protected and processed in accordance with applicable personal data protection legislation and other applicable data-protection requirements.
Tictic.me may process personal information where necessary for User registration and verification, operation of the Platform, processing of transactions and payouts, fraud prevention, security, customer support, dispute resolution, compliance with legal obligations and other purposes necessary for providing the Platform’s services.
Subject to the User’s separate consent, Tictic.me may use the User’s registered email address to send information about upcoming Events, new Tickets and listings, Platform updates, special offers, promotions, and other Tictic.me news and marketing communications.
Consent to receive marketing communications is voluntary and separate from acceptance of these Terms and Conditions. Marketing consent is not required to register, purchase or sell Tickets, or otherwise use the Platform.
Users may withdraw their marketing consent at any time through the unsubscribe mechanism provided in marketing communications or another simple method made available by Tictic.me. Withdrawal of marketing consent shall be free of charge and shall not affect the User’s ability to continue using the Platform.
Withdrawal of marketing consent does not affect operational, transactional, security, legal or service-related communications necessary for the User’s account or use of the Platform, including communications relating to registration, verification, orders, Tickets, transactions, disputes and Seller payouts.
Tictic.me may maintain records of marketing consent and withdrawal of such consent as required by applicable law.
The contractual relationship between Tictic.me and the User commences upon verification and activation of the User account.
The User relationship is unlimited in time and may be terminated by either party, subject to these Terms and Conditions and applicable law.
Termination of the User relationship with Tictic.me shall not affect contracts already concluded between Users through the Platform or any obligations arising from transactions completed prior to termination.
Following termination, the User may no longer have access to their account, subject to applicable legal requirements concerning retention of data and records.
Tictic.me makes no warranty and assumes no responsibility for the correctness or completeness of statements, information or content provided by Users.
In particular, Tictic.me does not independently verify the correctness and completeness of all information provided by Users regarding Events and Tickets and does not independently authenticate or guarantee every Ticket or QR code offered through the Platform.
Tictic.me does not guarantee that a User will be able to resell a Ticket after acquiring it.
Users, and particularly Buyers, are encouraged to follow official Event information and relevant media in order to remain informed about date changes, postponements, venue changes or cancellations.
Tictic.me remains available to Users, Event organizers and competent public authorities.
For matters requiring official review or action by Tictic.me, including listings, orders, Tickets, transactions, payouts, fraud prevention, disputes and customer support, the only official communication channel is:
Where applicable, Users should include their User Number/ID, Transaction ID, Ticket ID, Event information, description of the issue and relevant supporting information or evidence in their communication.
Tictic.me encourages Buyers to rate and review Sellers following Events.
User reviews contribute to trust and transparency within the Platform and assist other Users in making informed purchasing decisions while reducing the risk of improper or dishonest behavior.
The Seller represents and warrants that the Event data and information provided in the listing and on the Ticket is correct and complete, particularly with respect to the original price, date, area, section, row, seat, category and any applicable restrictions or concessions.
The Seller shall provide the Buyer with all relevant information, data and documents regarding the Event and Ticket. Information regarding Tickets and their characteristics must be provided objectively and accurately.
The Seller must upload a clear and high-quality media file (QR code or other applicable Ticket file) where required by the Platform. Such file will become accessible to the Buyer in accordance with the applicable purchase and Ticket-delivery procedure.
Upon posting an offer on the Platform, the Seller guarantees that they are entitled to sell and transfer the listed Ticket to the Buyer.
The Seller further guarantees that the sale is not subject to statutory restrictions or restrictions imposed by the Event organizer that would prevent lawful transfer of the Ticket on the secondary market.
All relevant information, concessions or limitations necessary for the Buyer to make an informed purchasing decision must be specified in the listing.
It is prohibited to list Tickets on Tictic.me that are already listed for sale through other channels. If a Ticket listed on Tictic.me is subsequently sold or otherwise becomes unavailable, the Seller must immediately remove or deactivate the listing.
By maintaining an active listing, the Seller confirms that the Ticket remains available and that the Seller is able to fulfil the transaction if the Ticket is purchased.
Failure to fulfil a completed transaction may result in liability to the Buyer and/or Tictic.me in accordance with these Terms and Conditions and applicable law.
Following a successful transaction and subject to these Terms and Conditions, the Seller is entitled to receive the Ticket sale price. Seller payouts are processed within 5 working days after the Event.
For international Sellers, payouts are processed in USD through an international fintech/payment organization.
Any transaction, transfer, banking, payment-processing, or other third-party financial institution fees associated with the payout may be deducted from the amount payable to the Seller.
The final amount received may therefore vary depending on the payout method, country, and financial institution. Tictic.me is not responsible for fees or deductions applied by third-party financial institutions.
The Seller is responsible for providing accurate and valid payout information. Payout information must correspond to the verified Seller’s identity, and the Seller may not provide the identity or payout details of another person or third party.
Tictic.me may impose sales price caps or other restrictions for specific Events, Sellers or jurisdictions where appropriate or legally required. Sellers will be informed of applicable restrictions through the Platform, notification or email.
Tictic.me may suspend or delete Seller listings if it receives notice of unlawful behavior or a breach of applicable rules, including consumer-protection requirements.
The Seller authorizes Tictic.me to modify listing information such as Category, Section and/or Concessions where necessary to correct the information structure or presentation of the listing. Where a listing is modified by Tictic.me, the Seller remains responsible for reviewing its accuracy and, where necessary, correcting, pausing or deleting it.
The Seller shall not use Tictic.me trademarks without prior written permission.
The Seller shall be liable where they are not legally entitled to sell or transfer the listed Ticket. Sellers may only list Tickets that they possess or that have been validly allocated to them.
Where a Seller breaches these Terms and Conditions, Tictic.me reserves the right, subject to applicable law, to suspend or block the Seller’s account, withhold applicable funds, and seek compensation for financial losses or damage caused to Tictic.me, including harm to the Platform’s image and reputation.
Sellers shall not directly contact Buyers by email, telephone or social media for the purpose of conducting transactions outside the Platform. Violation of this provision may result in restriction or blocking of the Seller’s account and other measures permitted under these Terms and Conditions.
If an Event is postponed or moved to another venue, including the rescheduling of a previously cancelled Event, the purchase remains binding provided that the Ticket remains valid for the new date and/or venue. Where reasonably possible, the Seller is responsible for assisting with changes required by the Event Organizer.
The posting of a Ticket for an Event on the Platform constitutes a binding offer for the conclusion of a contract between the Seller and Buyer at the price determined or accepted by the Seller.
A contract between the Seller and Buyer regarding the purchase of the Ticket shall be deemed concluded upon acceptance of the offer by the Buyer.
The Buyer accepts the binding offer by placing an order through the “Buy Now” function and successfully completing the transaction.
The Total Price may consist of:
(i) the Ticket price (“Sales Price”);
(ii) the applicable Tictic.me service/commission fee; and
(iii) any applicable charge or fee associated with the selected payment method.
The Buyer is obliged to pay the Total Price, including any applicable Platform service/commission fees and transactional fees displayed during the purchase process.
The applicable Tictic.me service/commission fee may vary depending on the Event, Ticket, market, transaction or other relevant factors and will be displayed to the Buyer before completion of the transaction.
All sales completed through Tictic.me are final.
Once the Buyer has completed the transaction and received the order confirmation, the transaction cannot be cancelled or refunded solely because the Buyer has changed their mind or no longer wishes to attend the Event.
Refunds may only be considered in accordance with Tictic.me’s applicable dispute procedures.
Tictic.me’s service/commission fee is non-refundable, except where Tictic.me expressly determines otherwise in a specific case.
The Seller determines the sale price in the currency available or permitted through the Platform. Where currency conversion is involved, the Buyer acknowledges that exchange rates and additional charges may be applied by their bank, card issuer, payment provider or other financial institution.
The Buyer is responsible for safeguarding any online Ticket, QR code, access code or other Ticket credentials received through the Platform and must ensure that such information is not shared or made accessible to unauthorized third parties.
The Buyer shall not use Tictic.me trademarks without Tictic.me’s prior written permission.
If a Buyer experiences a material problem with a Ticket, including non-delivery, inability to access or use the Ticket, an invalid Ticket, or another issue preventing its intended use, the Buyer should first contact the Seller through Tictic.me’s internal chat and attempt to resolve the issue directly.
If the issue is not resolved, the Buyer should notify Tictic.me through its official support channel, Support@tictic.me, provide the relevant Transaction ID and Ticket ID, and describe the issue together with any available supporting information.
Upon receiving a claim, Tictic.me may temporarily suspend the Seller’s payout while the matter is reviewed. The Buyer and Seller will first be given an opportunity to resolve the matter by mutual agreement.
If no agreement is reached, Tictic.me may keep the payout suspended for a reasonable period while the affected party exercises any available legal remedies and provides relevant official documentation.
Tictic.me will act as a neutral intermediary and, where legally required, cooperate with competent authorities and provide relevant information recorded within the Platform.
Nothing in this procedure limits either party’s right to exercise any rights or remedies available under applicable law.
These Terms and Conditions constitute the general framework governing the use of the Tictic.me Platform and the relationship between Tictic.me and its Users.
Tictic.me may update these Terms and Conditions from time to time where necessary to reflect changes in the Platform, applicable law, payment procedures, security requirements, or other operational matters. Updated Terms will be made available through the Platform.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions may be made available in multiple languages for the convenience of Users. In the event of any inconsistency or difference in interpretation between translated versions, the English version shall prevail, to the extent permitted by applicable law.
By continuing to use the Platform, Users are expected to comply with these Terms and Conditions and to use Tictic.me in good faith, responsibly, and with respect for the rights and interests of other Users.
